Story submission terms and conditions
You may submit as many photographs as you wish; however, you must complete a separate on-line submission form for each photograph. The image may originate in a non-digital format (such as high quality film slides, negatives or prints scanned into a digital format) so long as it is submitted electronically. Photos must be submitted in JPEG (as .jpg files) or .PNG format and should not exceed 2 MB. You must submit the actual image file, not a link or other type of file. No photo montages or composite images will be accepted. Electronic files submitted to Pets for Patriots will not be returned.
By making a submission, you warrant that the story and photograph that you submit is original and is your own, and does not infringe on the rights of any third party. You further warrant that your submission does not violate any agreement between you and a third party.
By making a submission, you grant Pets for Patriots the non-exclusive right to publish, use, distribute, reproduce and publicly display your story and photograph, and to create derivative works from your story and photograph, in perpetuity, in any of its on-line, print or other media publications, materials or exhibitions, for purposes of promoting Pets for Patriots’ mission and awareness of its program, including but not limited to for editorial, advertising, publicity, and fundraising purposes, without payment of compensation unless prohibited by law. You grant Pets for Patriots permission to provide your name, and your city and state of residence, when publishing, reproducing or otherwise using your story and photograph. While Pets for Patriots will make every effort to credit you when using your photograph and story, there may be circumstances where it is not possible to do so. Subject to the rights granted to Pets for Patriots, you retain all other copyrights and rights to future use of the photographs and stories you submit to us.
By making a submission, you warrant that your photograph(s) does not include a recognizable person or people. However, If your photograph(s) include a recognizable person or people, you must secure permission from each person. (Download our model release form.) Or in the case of a minor, the minor’s parent or guardian, to use his/her image in the photograph submitted to us, and present it to Pets for Patriots, if requested. Click here for a model release form for minors. Pets for Patriots reserves the right not to use a submission if it finds, in its sole discretion, that you have not secured a necessary release.
Additional Terms
By submitting your story and photograph, you consent to Pets for Patriots’ use of your name, likeness, voice, and/or biographical information for promotional and other purposes without additional compensation, except where prohibited by law. By submitting your story and photograph, you acknowledge compliance with these Rules and agree to release Pets for Patriots, its affiliates, and its officers, directors, employees, independent contractors, representatives, and agents (“Releasees”) from and against any claim or cause of action arising out of submitting your pet story and photograph to us.
Legal Terms and Conditions
It is your responsibility to determine that you are eligible to submit your story and photograph and to comply with the entry instructions and other rules set forth herein.
In the event of a dispute relating to the identity of the submitter, the submitter will be deemed to be the authorized account holder of the email address used to submit the story. The authorized account holder shall mean the natural person who is assigned to an e-mail address by an Internet Access Provider, online service provider, or other organization (e.g., business, educational institute) responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
Pets for Patriots reserves the right to edit your story as necessary (i.e., to correct typographical or grammatical errors) before posting on the website. Pets for Patriots reserves the right not to use your submission if, among other reasons, you breach the warranties you are required to make, you have failed to secure permission from persons whose recognizable images appear in the photograph(s), the submission is deemed to be inappropriate, or if your submission is lost, misdirected, incorrect, garbled or incompletely received, for any reason whatsoever, including by reason of hardware, software, browser or network failure, malfunction, congestion or incompatibility with Pets for Patriots’ servers. Pets for Patriots further reserves the right to seek damages against you to the fullest extent permitted by law, if you intentionally or recklessly damage the Pets for Patriots website or tamper with operation of the website or otherwise undermine the legitimate operation of the submission process, or attempt to do so. Such actions may violate criminal and civil laws.
By submitting your story and photograph, you agree to release Pets for Patriots and its affiliates, and their officers, directors, agents, attorneys, employees and representatives, from any and all liability for any claims, demands, causes of action, damages, judgments or settlements, or for any losses or injury to earnings, profits, or goodwill, or for any direct, indirect, special, punitive, incidental or consequential damages, including attorneys’ fees and court costs, other than entrant’s out-of-pocket expenses (if any) associated with submitting your story, arising out of or relating to this submission, your access or lack of access to the Pets for Patriots Web site, or in connection with any use by Pets for Patriots of the story and photographs submitted.
By submitting your story, you hereby agree to defend, indemnify and hold harmless Pets for Patriots and its affiliates, and their officers, directors, agents, attorneys, employees and representatives, against and from all third party claims, demands, causes of action, damages, judgments or settlements, including reasonable attorneys’ fees and court costs, arising out of or relating to this story submission, or any use by Pets for Patriots of the story and photographs submitted. In the event of any dispute, controversy or claim between a submitter and Pets for Patriots, the parties shall first seek to resolve the dispute through informal discussions.
In the event any dispute, controversy or claim cannot be resolved informally, the parties agree that the dispute, controversy or claim will be settled by binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association in effect at the time of commencement of the arbitration, and the parties agree that judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
